SEXUAL HARASSMENT PREVENTION TRAINING

CALIFORNIA LAW, AB 1825, requires all employers with 50 or more employees, including temporary employees and contract personnel, to put all supervisory employees as of July 1, 2005 through at least two hours of sexual harassment prevention training by January 1, 2006. New supervisory employees must participate in this training within six months of their assumption of supervisory positions.

Although AB 1825 does not specifically define "supervisor", the definition contained in the California Fair Employment and Housing Act (FEHA) presumably applies:

Any individual having the authority to hire, transfer, suspend, layoff, recall, promote, discharge, assign, reward or discipline other employees, or the responsibility to direct them, or to adjust their grievances, or effectively to recommend that action...if the exercise of that authority is not merely routine or clerical nature, but requires the use of independent judgment.

Are you in compliance? Failing to comply opens up employers to potential lawsuits.

Training on Sexual Harassment Prevention includes

¸Pre-test (sent to participants prior to the training) and post-test (toward the    end of the training), results of both tests reviewed
¸Information and practical guidance regarding the federal and California    statutory provisions concerning the prohibition against and the prevention and    correction of sexual harassment
¸Relevant, realistic and current examples including litigation
¸Open discussion of “Romance in the Workplace”
¸Attention to bullying and harassment on the job
¸Review of remedies available and provided to victims of sexual harassment
¸Focus on the employer’s procedures (and general procedures) on how to    address a Sexual Harassment complaint
¸Bound materials may include a copy of the employer’s policies and    procedures
¸Certificate of Completion for each participant, with copies for the employer’s
   HR files
¸Availability after the training for company-specific questions
¸Discounted one-hour session forall employees

NOTE: Participation in this training does not and cannot insulate the employer from liability for sexual harassment
